PRIVACY POLICY OF ALIVIA HOME DELIVERY

Alivia Home Delivery (“ALIVIA-HD”) is a service provided through a mobile application and a website owned and operated by a third-party contractor, not by Alivia Home Delivery itself. Medications purchased through ALIVIA-HD will be dispensed by Alivia Home Delivery, LLC, a duly licensed pharmacy in Puerto Rico (the “Pharmacy”), and delivered by a courier contracted by the pharmacy.

Your access to ALIVIA-HD’s mobile applications and websites is subject to the Terms of Use, Disclaimers, Express Consent, and this Privacy Policy (“Privacy Policy”).

 

General

We may collect non-personal information and personally identifiable information through ALIVIA-HD, which may be used to provide you with personalized services, content, industry-related information, and for ALIVIA-HD’s general business purposes.

By using ALIVIA-HD, you accept and agree to be bound by the Terms of Use and this Privacy Policy. Specifically, by using ALIVIA-HD, you consent to the collection, use, and disclosure of your non-personal information and personally identifiable information obtained through ALIVIA-HD in accordance with the Terms of Use and this Privacy Policy.

This Privacy Policy may be modified at any time without prior notice and at our sole discretion. Amendments to this Privacy Policy will become effective on the date they are published on the ALIVIA-HD application or website. Therefore, you should review this Privacy Policy periodically.

Your continued access and use of ALIVIA-HD after the effective date of any amendments to this Privacy Policy signify your acceptance of these amendments. If you do not agree to be bound by (or cannot comply with) the terms of this Privacy Policy as amended from time to time, your sole remedy is to stop using ALIVIA-HD. Your continued use of ALIVIA-HD constitutes your consent to be bound by this Privacy Policy and the Terms of Use (latest version).

For the purposes of this Privacy Policy, your use, access, and/or visit to ALIVIA-HD includes:

• Partially or fully registering with ALIVIA-HD

We are strongly committed to protecting the confidentiality of your personal information. The term "Personal Information" includes any information that can be used to identify you, such as:

ALIVIA-HD is intended for residents of the United States and Puerto Rico and for deliveries within Puerto Rico.

 

Collection, Use, and Retention of Personal and Non-Personal Information

To take advantage of ALIVIA-HD and receive electronic communications from ALIVIA-HD (if applicable), you must be a registered user.

Types of Information We Collect:

1. Personal Information: Required for registration and access to ALIVIA-HD services.

2. Non-Personally Identifiable Information: Includes, but is not limited to: 

   • Type and version of your internet browser

   • Your IP address

   • Your general geographic location

   • The operating system and version you use

   • The domain name of your internet service provider

   • Aggregated data from all visitors and/or registered users

If you choose not to register with ALIVIA-HD and do not provide Personal Information, you will not be able to access ALIVIA-HD.

We may collect your Personal Information when you use ALIVIA-HD or register for it. We may also collect Personal Information if you submit information to ALIVIA-HD but do not complete the registration process.

We reserve the right to retain all Personal Information and Non-Personally Identifiable Information indefinitely.

 

Geolocation Information / Mobile Devices

Certain features and functionalities of ALIVIA-HD depend on your location. To provide these features and functionalities, we may—with your consent—automatically collect geolocation information from your mobile device or cellular provider (collectively, “Geolocation Information”).

• Geolocation Information is collected only when the ALIVIA-HD app is running on your mobile device.

• You may refuse to allow us to collect your Geolocation Information. However, if you do so, we may not be able to provide certain features or functionalities.

We may also collect information about:

​

• Mobile device type

• Advertising identifier (e.g., IDFA or AdID)

• Operating system and version (e.g., iOS, Android, or Windows)

• Cellular provider

• Network type (WiFi, 3G, 4G, LTE)

 

Use by Minors or Representation of Minors

​

ALIVIA-HD is not designed for or intended to attract users under 18 years old.

​

• If you are under 18, do not use ALIVIA-HD.

• However, a parent, guardian, or other legally authorized person (“Authorized Person”) may register to access ALIVIA-HD on your behalf.

​

When you turn 18, we may:

​

• Permanently disable the Authorized Person’s account

• Require you to register for ALIVIA-HD access

• Provide you with notice of your available options

• Confirm whether the Authorized Person may continue acting on your behalf

• Obtain confirmation that you have taken control of the account previously managed by the Authorized Person

We are committed to preventing the unintentional collection of Personal Information and Health Information from children under 13 years old.

​

If you are a parent or legal guardian of a child under 13 years old and believe that they have directly provided Personal Information or Health Information to us, you have the right to review that information or request its removal from our database.

Cookies

​

When you visit or register with ALIVIA-HD, your computer or device may receive a “cookie” or “GIF file”(collectively, “Cookies”) to assign a unique and anonymous identifier to your browser, computer, and/or device.

A Cookie is a small data string that allows ALIVIA-HD to remember you, similar to a membership ID.

• Why We Use Cookies:

  • To remember your preferences and enhance your experience.

  • To provide a more convenient experience when you visit ALIVIA-HD.

• Cookie Storage:

  • Cookies are stored on your hard drive and contain non-personally identifiable information.

  • You may delete and/or block Cookies from your browser or device, but this may affect the quality and/or performance of ALIVIA-HD.

  • To disable and reject Cookies, follow the instructions specific to your browser or device.

Generally, we do not restrict our use or disclosure of Non-Personally Identifiable Information collected through ALIVIA-HD.

• Non-Personally Identifiable Information may be used for analytics purposes, to improve ALIVIA-HD, and for other purposes, including but not limited to business purposes.

• We may sell, rent, lease, or otherwise provide third parties with Non-Personally Identifiable Information that you provide to ALIVIA-HD (or that we generate from de-identified Personal Information).

• These third parties may offer business opportunities, services, or sales promotions to you, with or without our sponsorship.

We may conduct statistical analyses of traffic patterns, ALIVIA-HD usage behaviors, and user interactions.

• These analyses allow us to generate Aggregated Data from original Non-Personally Identifiable Information.

• Aggregated Data refers to summary-level data (e.g., number of users of a specific gender in a specific zip code).

• Aggregated Data does not contain information that can be used to identify or contact you personally (e.g., name, address, phone number, or email).

• We may sell or disclose Aggregated Data to other companies or organizations.

Additionally, we may contract third-party service providers to collect Non-Personally Identifiable Information from linked websites and share it with us.

• These third-party providers will not be able to convert Non-Personally Identifiable Information into Personal Information.

2. In case of business transfer – If ALIVIA-HD is sold, acquired, or merged with another entity, we may transfer your Personal Information to the surviving entity, provided that it agrees to handle your data according to this Privacy Policy.

3. To protect our rights or comply with legal obligations – We may disclose Personal Information to relevant authorities if we believe it is necessary to identify, contact, or take legal action against individuals causing harm to our rights, property, users, or any other party affected by their actions.

ALIVIA-HD does not control this data collection, and its use is subject to the app store’s privacy policies.

• The ALIVIA-HD app
